Client Rights
When you feel that your rights have not been upheld by Personal Growth Counseling Services, you have the opportunity to file a grievance in a confidential and accessible manner.
Personal Growth Counseling Services' Client Rights Officer must take all necessary actions using the grievance procedures to fully investigate and resolve all grievances filed with the agency.

Client Rights include, but are not limited to, the following:

The right to be treated with consideration and respect for personal dignity, autonomy, and privacy.

The right to be fully informed of all rights prior to consent for treatment and to be request a written copy of these rights.

The right to reasonable protection from physical, sexual, or emotional abuse, neglect, and inhumane treatment.

The right to receive services in the least restrictive, feasible environment.

The right to participate in any appropriate and available service that is consistent with an individual service plan (ISP), regardless of the refusal of any other service, unless that services is a necessity for clear treatment reason and to ensure the person's participation.

The right to give informed consent to or to refuse any service, treatment, or therapy, including medication absent of an emergency.

The right to participate in the development, review, and revision of one's own individualized treatment plan and receive a copy of it. This includes periodic ISP reviews with the staff including services necessary upon discharge.

The right to freedom from unnecessary or excessive medication, and to be free from restraint or seclusion unless there is immediate risk of physical harm to self or others.

The right to be informed and the right to refuse any unusual or hazardous treatment procedures.

The right to be advised of and the right to refuse observation by others and by techniques such as one-way vision mirrors, tape recorders, video recorders, television, movies, photographs or other audio and visual technology. This right does not prohibit an agency from using closed-circuit monitoring to observe seclusion rooms or common areas, which does not include bathrooms or sleeping areas.

The right to confidentiality of communications and personal identifying information in accordance with state and federal law, including HIPPA and 42 CFR Part 2.

The right to review and obtain a copy of one's own record, and to request amendments, as permitted by state and federal law.
The Client Rights Officer is responsible for accepting and overseeing the grievance process of any grievance filed by a client or other person or agency on behalf of a client. If the Client Rights Officer is the subject of the grievance or is unavailable, an alternate Client Rights Officer can be contacted.

The Client Rights Officer is available to assist clients with their complaint(s), help clients exercise their rights, investigate grievances, and monitor the agency's implementation of the state administrative and federal code regulations concerning clients' rights and 42 CFR Part 2, and Privacy of Protected Health Information. The Client Rights Officer is responsible for explaining all aspects of the agency's grievance procedures.
You may also file a civil rights compliant with the U.S. Department of Health and Human Services, Office of Civil Rights electronically through https://ocrportal.hhs.gov/ocr/portal/lobby.jsf, or by mail or phone as indicated below. There will be no actions taken against any person exercising their right to file a complaint. You may obtain private counsel at your own expense.
